Six former America West Airline pilots filed a lawsuit in Federal Court for Arizona asking for an injunction against US Airways. According to an article published in the Charlotte Business Journal:
"A group of former America West Airlines pilots are asking a federal court in Phoenix to stop US Airways Group Inc. from furloughing any more pilots that flew for America West."
The six pilots believe that such furloughs would impede upon the rights of former America West pilots if preferential treatment is given to pre-merger US Airways pilots.
America West merged with US Airways in 2005. The transition has been incredibly rocky, especially for the pilots that once flew for America West. US Airways, which operates its largest hub at Charlotte/Douglas International Airport, will reduce its domestic flights which will cause at least 300 pilots to be placed on leave. Although they will retain the ability to be called back, should need arise, there is still no guarantee for future work.
The law suit also contends that former America West pilots have not been properly represented by their labor unions as it relates to collective bargaining, seniority rights, and layoff/recall rights.
